Réflexions sur le processus d'institutionnalisation au temps des dauphins de la deuxième race (1183-1282)

The process of the institutionalisation of the land of the Dauphins began with the princes of the so-called ‘second race’ (1183-1282). It is this initiation which is the subject of this study. The voluntary nature of this process is stressed, more the result of the rapid transformations led by the prince than the gradual shifts, by antonomasia, of habits that were progressively ratified legally. The role of a strong notarial presence in the principality is not to be neglected in the understanding of these evolutions. Such an analysis is as valid for the curial institutions (chancery, supreme justice) as for the local institutions (lordships, completely transformed at that time).
Le processus d’institutionnalisation des terres dauphinoises est tout juste amorcé par les princes dits de la «deuxième race» (1183-1282). C’est cette amorce qui fait l’objet de cette étude. Celle-ci insiste sur la part volontariste de ce processus, issu davantage de transformations rapides dirigées par le prince que de glissements progressifs, par «antonomasie», d’habitudes progressivement entérinées juridiquement. Le rôle d’un fort milieu notarial dans la principauté n’est pas à négliger pour comprendre ces évolutions. Une telle analyse vaut aussi bien pour les institutions curiales (chancellerie, justice suprême) que pour les institutions locales (châtellenies, totalement remodelées à ce moment-là).
